Representation is more than opening a door.

The listing agent represents the seller. A builder’s sales representative works for the builder. A buyer’s agent gives you someone whose role is to help protect your interests and explain the decisions in front of you.

What is buyer representation?

Buyer representation is a professional relationship between you and a real estate brokerage. It is established through a written agreement that explains the services, responsibilities, duration and compensation involved.

Limited nonrepresentation

Texas allows a written nonrepresentation arrangement for the limited purpose of showing property. This is not the same as having an agent who represents you.

  • Basic property size, price and terms
  • No opinions or strategic advice
  • No negotiation guidance
  • No additional buyer brokerage services

Why it is in writing

The agreement creates clarity before the work begins.

Beginning January 1, 2026, Texas law requires a written agreement before a real estate license holder shows residential property to a prospective buyer. If no property will be shown, an agreement is required before presenting an offer on the buyer’s behalf.

The purpose is to make sure you understand whether you are represented, what services will be provided, how long the relationship lasts and how the brokerage will be compensated.

The agreement should explain:

  • The services being provided
  • The area or properties covered
  • The beginning and ending dates
  • Whether the agreement is exclusive
  • How the brokerage will be compensated
  • That compensation is negotiable
  • How the agreement may be amended

No surprises

How buyer-agent compensation works

Your representation agreement states how the brokerage will be compensated. The amount is negotiable and is not set by law.

The seller may pay it

We may be able to request that the seller pay some or all of the agreed compensation as part of your offer. Seller payment is not guaranteed.

A builder may offer compensation

Some builders offer compensation to the buyer’s brokerage. The builder’s sales representative still works for the builder, not the buyer.

The buyer may have a responsibility

If another party does not pay the full amount agreed upon, the buyer may be responsible for the difference under the representation agreement.

Good representation requires open communication, reasonable expectations and mutual trust. Neither of us should feel stuck in a working relationship that is no longer a good fit.

Common questions

Buyer representation FAQs

Do I have to sign an agreement before seeing a home?
For residential property in Texas, a written agreement is required before a license holder shows you the property. The agreement may provide full representation or may be limited to a nonrepresentation showing.
Does signing an agreement mean I must buy a home?
No. The agreement explains the terms of our working relationship, but it does not require you to purchase a property.
Can I contact a listing agent or builder directly?
You can, but let them know you are represented and provide my contact information. The listing agent represents the seller, and the builder’s representative works for the builder.
What if I find the home myself online?
Send it to me. Finding the listing is only one part of the process. I can help evaluate it, arrange access, review pricing, prepare an offer and manage the transaction.
Can we end the representation agreement early?
If either of us believes the relationship is not working, we should discuss the concern directly. When appropriate, we can ask the brokerage to amend the agreement or establish an earlier ending date. Existing obligations must still be properly addressed.
Who is the agreement actually with?
The representation agreement is between the buyer and the real estate brokerage. I provide the services as a licensed agent sponsored by that brokerage.
